The TU Ilmenau is committed to the free and international exchange of knowledge. At the same time, we bear the responsibility of ensuring that our research findings and technologies are not misused for the development of weapons of mass destruction or for military purposes in countries subject to sanctions. Compliance with export control regulations is not at odds with academic freedom, but rather a legal necessity that protects both the university and you personally from criminal consequences. The legal basis for this includes, amongst others, the Foreign Trade Act (AWG), the Foreign Trade Ordinance (AWV) and the EU Dual-Use Regulation.

 

What do you need to bear in mind?

Export control is essentially based on the so-called four ‘W’ questions (areas of assessment):

  • What? (Goods assessment): Are these dual-use goods, software or technologies listed in the EU Dual-Use Regulation?
  • Where? (Country assessment): Are there any specific embargoes in place against the country of destination (e.g. Russia, Iran)?
  • To whom? (Person assessment): Are any project partners or visiting researchers on international sanctions lists?
  • For what purpose? (End-use assessment): Is there a suspicion of (indirect) military end-use?
 

Relevant scenarios in academia

At the TU Ilmenau, export control is primarily relevant in the following areas:

  • Technology transfer: Sending data, source code or technical know-how via email, the cloud or data storage media (ITT – Intangible Technology Transfer).
  • Shipment of goods: Export of prototypes, measuring instruments or laboratory equipment for collaborative projects or field research.
  • Staff & visitors: Recruitment of staff or hosting of visiting researchers from third countries for security-relevant departments.
  • Business trips & conferences: Taking sensitive data or high-performance hardware abroad.
