Access restrictions

Archival records are generally released for access 30 years after the documents were created. The time of creation corresponds to that of the last processing of the documents. ThürArchivG § 17 Abs. 1

Archival material concerning personal data, like records personnel or student file, is released for access 10 years after the death of concerning person. If the year of death cannot be determined or can only be determined with great effort, the protection period ends 100 years after the birth of the person concerned. If their year of birth cannot be determined or can only be determined with unreasonable effort, the protection ends 60 years after the records were created. ThürArchivG § 17 Abs. 1

Archival material that is subject to special confidentiality regulations (e.g. tax or banking secrecy) may only be used 60 years after its closure. For archival material with personal data that ist subject to special confidentiality regulations is released for access 30 years after death, if the year can be determined. If the year of death cannot be determined or can only be determined with unreasonable effort, the archival material is released for acces 130 years after the year of birth. Can neither the year of birth nor the year of death be determined, the archival material may be used 90 years after its closure. ThürArchivG § 17 Abs. 3

The term of protection does not apply to archived material, that was intended for publication when it was created or that was already accessible within the meaning of the information access laws before being handed over to the archive. Likewise, the protection period does not apply to archival material from the GDR, unless it concerns personal documents.
